If both names are on the account he can be held liable for credit purposes but if she is signing the checks she well be held for legal purposes. If she is FORGING the checks he can get all of the money back if her name is NOT on the account. A check written in the ammount of 500 or over that is bad is considered a felony. He needs to alert the bank immediately. He also needs to contact the credit bureaus and cancel any and all credit cards. Giving the credit bureua a heads up will help. Canceling credit cards will help as well. Its sad that this happens all the time. Unofrtunately when two people are on account its a legally binding agreement that they agree to use the funds mutually. he also NEEDS to get in touch with his financial office IMMEDIATELY!!! He probably has direct deposit. He needs to cancel that FIRST before he does anything else. That way no more money can be put into that account and can be directed to another. If he has a best friend or family member (family is best) to open an account is his name and forward all the financial info to him. He may need to assign power of attorney to someone he trusts on his behalf. This happened to my friend. I hope it all works out but he does need to contact his financial office first and have his paychecks redirected. If he cant open an account without him being there, he should contact the bank he has an existing account with and open a new one if they will let him. He can then put his checks into that account.

unfortunatly what is theirs is theirs no matter where it comes from she can spend every thing she wants from the account . the man may have to sever ties with this woman and take some proactive steps to secure his debts .ie take out a loan and pay off every thing so not to destroy his credit any worse. send the landlord a notorized letter of his wishes not to continue the lease and that she is on her own. contact the bank and find out if there is certain papers he needs to fill out to have his name withdrawn from the account if he cant then he might need to arrange for a another account and have his direct deposit changed. contact the credit card companies of closing accounts or ask for their remedies to situations like this this is more common then you might think .... my father in law had it done to him while he was on deployment and he came back to his wife handing him the keys to his truck and a cleaned out account and everything he had taken. but secure the credit reports and slowly make your way out of the whole. becuase he is in the military he has a place to live so he should be able to move a little bit quicker with finacial the creditors will enter into his file an affidavit stating what happen and they will see if he is earnestly trying to recover same thing with credit report companies....... i would however stay in the navy till he has reestablished his credit worthyness becuase you more ept to get credit on items while in then when you enter the outside world.... good luck sounds like he needs alot of it. and our house spits on morons like this woman to trash his name while he is fighting for her freedom..... please tell him we all are praying for him and that we thank him for his service.

Yes it is. He can contact JAG about this as well. If she is not paying the bills or doing what she is suppose to be doing while he is overseas (deployed) it can get him into trouble with his chain of command unless his chain of command knows what is going on and is trying to help the soldier resolve this matter.
He can get online and change his direct deposit of his military pay to go into another account just in his name.
She is in the wrong for writing bad checks, it makes her credit look bad and as well as his. She can go to jail as well.
He needs to appoint someone else he can trust to handle his finances while he is deployed overseas.
There is JAG wherever the soldier is located at to help him.

That's not illegal unless only his names are on the account. But because they are married and he had trusted her, she can do these things without legal recourse. It is reprehensible, but there is little he can do about what's happened. He needs to separate their finances (appointing a family member power of attorney if necessary) and get caught up on the finances. He needs to exclude her from everything possible and get a divorce ASAP.

What she is doing effects her credit also....bet she didn't know that.......and yes, it is against the law....no matter where the spouse is....and he is not the one that will be held accountable for it.....too bad she has not a clue as to what she is doing to herself....however....he can contact his Commanding Officer, and he will help take care of this problem.....

I was in the military. My husband at the time drained our account constantly. So here's the crappy part. He is overseas...I don't believe he can anything about it.......because..........you have to be stateside to file divorce. It is however illegal to write hot checks. She can be arrested for it. Has he called the M.P's and let them know whats going on? Also, he needs to contact a lawyer wherever he is and tell him the circumstances and ask for his advice....its not going to hurt anything.

Looks like everyone gave good advice. Unfortunately this happens alot. Remember anything over $300 is a felony! What a POS, my hubby is deployed and I work, but would never screw him/ us over that way. Instead I made a bet with him on how much I could save :) I cant wait till he gets home and we can spend it together. Please tell him good luck, and use more caution next time.

it is not againist the law to take money out of account if the money is there. If she is writing bad cks, the state will press charges againist her if she fails to pay it back and he will have to repay all the debt once he returns home to clear his credit report.

if both of their names are on the accounts no its not against the law.. she's being an idiot yes.. Now im wondering, if he can have the direct deposit of his checks stopped to where he's paid and she has to depend on him sending her money ..since wants to be so irresponsible with the money..

yes. tell him to close all his accounts ASAP and contact the police and the credit bureaus and put an alert on it for fraud
