ok, a friend of mine has two children and everytime she does something that her mother doesn't like as far as raising her children, her mother throws a fit. She starts this crap about grandparents having more rights than the parents in the state of mississippi. It's really upsetting my friend and making her wonder about her mother's intentions. I'd like to know how much truth there is to her mother's whole "i'm a grandparent and i have more rights than you in the state of mississippi" trip so that i can put her mind at ease. Help Please!

Your friend's mother should but out, of the top of my head do not know the exact case but few years ago the US Supreme court ruled on this matter and they stated the biological/adopted parents have the only rights in regard to the child grandparents have no legal rights in general

US supreme court is law of the land and super cedes any state court so your fiends mother is way off base

Is your friend married to the father of the children? If so, the rights of an intact family overrule that of the grandparents. They can keep her away from the children.

If your friend is a single mother, there is a chance the child's grandmother could get visitation.

Here's the law;
Mississippi allows grandparent visitation if the grandparent has established a viable relationship with the child and the parent or custodian of the child unreasonably denies visitation. Viable relationship means that the grandparent has “voluntarily and in good faith” supported the child financially for at least six months or has had frequent visitation (including occasional overnight visitation) for at least one year.

Good luck to your friend. Hopefully her mother will stop playing games.

Biological parents ALWAYS have more rights than anyone else,UNLESS the family court has revoked those rights.

So tell "granny" she's blowing wind!
