In the TNG episode "Conspiracy", Picard receives a private message from Captain Walker Kiel, an old friend and fellow starship captain, who warns him of impropieties at the highest levels of Starfleet Command. After Kiel's ship is mysteriously destroyed, Picard decides to take the Enterprise to Earth and find out the whole truth. He and Riker are invited to dinner at Headquarters to discuss the situation .
Admiral Quinn, another old friend of Picard's, asks to come aboard. But the visit is a trick to infect Riker with the same parasite that has infected Quinn and who knows how many other top level officers in the fleet. An symbiotic alien race is trying to take over the Federation.
With what seems like superhuman strength, Quinn knocks out Riker, Geordi, and even Worf, before Dr. Crusher finally phaser-stuns him. When Riker is late to dinner Picard tries to call him, only to hear from Beverly that he was attacked by Quinn and she explains about the alien she found in his body. The point I'm getting to is when Beverly distinctly says this:
"Captain, you must set your phaser on kill. Stun has little effect."
As for stun settings on phasers, by the 24th century, more of a distinction is made between light and heavy (or maximum) stun.

The way it worked was this:
If it was the captain talking to his crewmembers, they would "set phasers to maximum." The good guys would say this to each other.
However, when the crew was talking to the bad guys they would often make note of the fact that the phasers were set to kill if they didn't comply. "Don't try anything, I've got this set to kill."

i'm sure they did, occasionally. It was always near the dramatic climax and always accompanied by "ohshit" music. I only ever watched the originals; i doubt that they do that in today's PC versions
