since your asking this question in the philosophy section, i will asume you are not asking the literal question of, can you kill in a way that will not be considered legal murder. if you are asking that question, i am amazed more by the people who are answering you than the quesion itself.
anyway, i will answer assuming your being metaphorical. if killing the spirit counts as death, then yes you can, becuase obviously spiritual death is metaphor and murder is literal.
the rapist causes two deaths, the rapists and the victims, but if the rapist is already dead before the rape, then how could the rapist kill someone else?

Legally speaking, any death which is cause in the course of committing a felony is considered murder. Therefore, if a rape victim dies as a result of a rape (for any reason), the rapist is legally considered guilty of both rape and murder.

Technically yes. If the assailant has AIDS, the victim can die from the rape, and it would not be murder under current law. (Whether it should be is another question)
Aside from that, I do not see how non-consensual sex can cause death without a murder taking place.

Yes it could. When someone is rape, he or she could be emotional. This could also cause someone to feel guilty and scared being hunted by the prey's look.
Some people gone mad too after they are being rape.

In some religions rape is death.
"There is nothing more tragic than the sight of a mutilated spirit."
But in truth, not likely.

I can see several ways:
1, STDs
2, complications during preagnancy resulting from rape.
3, suicide after rape
Some people might not agree, but I feel that way.
