Sometimes when I see a hot woman with a nice @ss walk by I have the urge to smack or grab her @ss. I thought that the worst thing that can happen is she slaps me and/or curses me out. But someone said this can be considered sexual assault and a felony that can lead to 3 years in prison. Is this true?

Touching someone like that could be considered assault and battery. After you are convicted, have fun being someone's ***** in prison.

Yes grabbing a woman in any manner can be called abuse. But in that particular spot you can also get felony assult plus sexual assault. Sexual assault can get you 1 to 3 years . and the Felony assault charges carry a 5 to 15 years.
Now if they run concurrent you would serve about 7 to 8 years and get out with good behavior. But if they are to be served consecutively then you would serve the 5 to 15 years first and then the 1 to 3 years. So you would wind up with 18 years.

Although such behavior may have been 'tolerated' in previous years, viewed as 'flirtatious' actions etc., that environment no longer exists. Not even during the teenage years, where it was most prevalent and considered 'experimental', is it accepted. Regardless of the intent, innocent or not, touching another person is and can be interpreted as a physical violation.

Depending on the circumstances, one risks being charged with a crime that runs the gamut from disorderly conduct, simple assault/battery, to aggravated sexual assault/battery, depending on the state where one lives. In essence, the chance for facing a felony charge is very possible. The length of incarceration for a conviction varies depending on the state. Moreover, if one is convicted, the label of a 'sex offender' is applied; a lifelong stigma!

The answer to your question is...Maybe. Your next question should be: 'Is it worth it?'

P.S. Although it is harrassing, without a doubt, one wouldn't be charged w/sexual harrassment! At least not criminally. Sexual Harrassment is a civil matter. You may want to share this with the other respondents that are such geniuses when it comes to law!

I don't know about felony, but I just had a younger guy friend arrested for just that. So yeah, but he was a minor so his parents got him out and now he has to go to court and all that stuff. Just cuz he had the urge to grab a womans ***. It is sexual assualt. It is an unwanted sexual gesture and charges can be pressed.

Any unwanted attention is considered unlawful. What makes you think you can just touch any part of a woman's body? That is an assault, a jail-able offense.

I'm not sure who would get charged -- but grab my@ss -- and one of us is differently getting charge with a felony -- me for whipping you @ss or you for grabbing mine -but one way or the other its going to be a crime

Grabbing a woman's *** is sexual harassment. I think it would qualify as a misdemeanor though...
