the answer will depend on your state residence. domestic relation issues are usually handled by state laws not federal laws. therefore the answer in Michigan will differ from the one in new jersey. that being said a test that will be used is know as the "best interest of the child." the answer to that question will be answered probably by the court in your jurisdiction. i would agree that you need to contact your department of family services. the answer to the above question can change depending on what they would want.

Probably none as the child is already born. If they are continuing to use it call the department of family services as the child will get high from the second hand smoke just like the parents.

If this is your child go to the local police station and explain what is going on and explain to them that you do not want your child exposed to this but you do not want to break the law. They will point you in the direction that you need to go. If that means setting it up to where the police comes in the middle then do it. The childs protection comes first. If this is not your child then please take action. GO to DCF and file a complaint. Protect the child.Please.
