i was in the hardees parking lot waiting on a friend. when an unmarked police suv pulled up and an undercover officer approached my car with his gun out. It was dark and late so when i saw a guy with a gun comming towards my car i got the hell out of there. when a marked car got behind me i pulled over and they rushed my car pulled me out of the window,threw me on the ground on my stomach,put my hands behind my back and started punching me in the face and kicking me. i had 2 go to the hospital for x-rays and pain/swelling meds. even if i was up 2 no good are they allowed 2 beat me up while im on the ground?

they got a tip that a dark colored 2 door car would have drugs in it..either way if im in custody for whatever they have no right to use violence on me

No, they are not allowed to do this.
This is called excessive force. Cops are not allowed to use more force then necessary, especially if they KNOW they are using excessive force.
Consider a civil lawsuit if you suffered some damage.

The federal law: 42 usc 1983 authorizes such a lawsuit.
Talk to a lawyer.

I dont think we are getting the whole story here.

First if a cop is trying to pull you over (even in a parking lot) they will turn on there lights once they are behind you.

Second he would of yelled that he is with the police dept as soon as he pulled his gun out.

Guess you have learned not to try to run from the police and I bet when they finally handcuffed you you actually tried using the excuse that you took off because you didnt know he was a cop.

Alright, this whole thing seems a little bit questionable.
Police officers do not go up to random people and take them down for now reason. You were obviously doing something illegal otherwise this wouldn't have happened.
They are certainly allowed to do anything it takes to take you into custody if they have reason to believe you are dangerous and/or suspicious.
Quit putting the blame on the cops and start looking at yourself. It is people like you that give law enforcement a bad name. You are blaming other people for your problems. Get a life.

This happens more frequently than a lot of people realize; however, the problem is that it is their word against yours if there are no witnesses.

The officer had an obligation to identify himself to you.

I do not know; however, if you have a case that is worth suing over. If you have no fractures, no scarring, and are going to recover in a couple of weeks, it isn't much of a claim.

What were you up to? Cops don't stop people for no reason and they certainly don't go around with guns drawn for no reason. What did you do?
