I work at a place called sweettooth and i havent been working there for very long, actually sunday was my first day, unfortunatly my mother fell very ill the first day of work and yesterday i found out she had to have surgery, so anyway to my point..i told my manager which by the way happens to be a 16 year old girl that i needed to be off at 1 even tho my shift was from 10-5, because i had no one to sit with my daughter who was being watched by my father who needeed to be at the hospital with my mom...she looked at me like i was stupid. later she and fellow co workers went to get food, after they ate i asked one of them to take over for me so i could go on break and use my phone because thats the only time u can use it. so she did and i called my dad to ask about mom and to let my fiance kno that i wouldnt be there to meet him for lunch, manager came out and said well i clocked u out so u can go cuz all u want to do is talk on the phone!!!!! she is such a little *****

You need to find new employment. You have a sixteen year old manager! How dumb can the owner be? You are an at will employee. I would say your were inappropriately sent home and if you are going to leave the job, I would talk with the owner. He needs to know so he can replace the manager. But if you stay with that person as your manager, your life will be miserable needlessly. It will be worse if the owner stood up for you as well.

Depending upon your state and the number of hours you were scheduled, you possess a legal right to a break. If you were sent home for taking it, that is a violation of wage and hour laws. You may have a valid complaint there.

Still, this manager is a walking disaster. Could you imagine what would happen if your next employer called her for your reference and she was mad at you? This girl is a real problem some grown up needs to deal with. Sounds like the owner is clueless.

This is true in most states. An employer can release you without cause for the first 90 days. They don't have to tell you why.

Yes, you were on break while using your phone.
Call the regional manager, he/she might see your side. (Did you clock out for break?)
If so, the time you clocked out and the time on your phone should coincide. Then, maybe you can get rid of the little*****.
