My child's father got a cash settlement in a civil suit from an accident on his job.

I didn't ask the question the right way. He got a settlement amounting to several million dollars. As part of the settlement he requested an extra amount to provide for his/our child's future in the amount of 80K. She will be 18 this year and it has come to light that he has spent the money!! I want to know if I can get that money for our child's college education.

yes you can especially if he owes back support. you need to contact your social worker and tell them about the settlement. They can handle it from there. Good Luck!

You don't have to ask, automatically as long as he HAS arrears then that will have to be satisfied before he gets his settlement... So yes, as long as he owes you money you will get part of the settlement. (whatever the amount of the arrears are)

Child support arrears are judgments. For example, If at anytime any one of us gets awarded a settlement, the lawyer that will give us the check will have to check for any judgments we may have, if we have a child support judgment that then that will have to be paid first-
