My husband and I left our children in the care of our neighbors, while we went for a drive around the neighborhood, garbage night. We were gone for about 6 minutes when a cop pulled us over. Husband called neighbors to tell them we got pulled over so we might be longer getting home. Asked what the situation was all about, told that they had received a call and someone had reported our children being neglected. Husband told him that our neighbors were watching the kids, he was then cuffed and we were brought in. We explained that our neighbors were watching our children; they were both in bed asleep. I was then brought to another room, filled out a statement, charged with two counts of child neglect, brought into the same room as my husband,who told me that cop had contacted our neighbors &were told that they were in fact watching the kids. Husband was charged with the two counts of neglect.Neighbor was arrested for child abandoment cause he left fora minute? Our houses are connected?

Got a copy of the report and found out who it was that called in. They live 5 minutes away from us. We have no clue who they are. And yes they read us our rights but before being put in the cop car. We were read them right before filling out our statements. Husband is also being charged with falsifying and oficial document and they asked him to fill out another statement truthfully and he wrote down "everything I worte on my last statement was all the truth"

I think that what they are gonna try to uphold in courts is that you left your children in the care of an incompetent adult. Which is why they are setting the charge of child neglect on you & your husband. I know it sounds crazy but it happens all the time. When you go to court I would advise you to have a good attorney. Unfortunately for your neighbor, he is guilty all the way. If he agreed to watch your children and left them alone then he is likely looking at some jail time. Even if your houses are connected, he still left them unattended.

First thing I would suggest, is to record all the testimonies of the neighbors saying that they were watching the kids. Also see if you can get a copy of the report itself.

Try to get as much evidence as you can and then contact a lawyer. Did the officer read you your rights? Is there a way you can find out who made the call? It sounds like there are a bunch of illegal precedents that went on.
