I know plenty of gay couples that are way more adjusted and secure than the whole slew of unstable straight couples I know.

It's been tried.

The problem is, it doesn't work. You just end up with people effectively divorcing each other without ever telling the government about it.

We live in a fluid changing culture. No one set of religious or moral values is going to work for everyone. Not everyone believes in the "til death do you part" mindset. And every attempt to enforce these ideas through law have dismally failed.

Just like laws that attempt to make it illegal to co-habitate without being married have dismally failed, and are being struck down as invalid. You can't force people to stay together if they don't want to be together. Just like you can't force people to get married if they don't want to get married.

Personally, I think the government should get out of the marriage business entirely. Do away with the entire legal concept of marriage, civil unions, domestic partnerships, etc. Make everything that is a matter of legal rights just a matter of filing the correct legal paperwork.

You want survivor's benefits? Fill out the paperwork and name your beneficiary. You want power of attorney and hospital access? Name your personal representative. You want community property? Form legal partnerships for owning property.

Or package up the most common legal benefits, just like the most common car options get a package. And let any two people register for those legal benefits as a package. Or cancel the registration, just like they can do with any other legal document.

The government should not be in the business of legislating personal relationships. It just doesn't work.
