being evicted?
i need help. being evicted for no good reason. just because husband left the job where he was working with the landlord because he found a better one and his wife wants friends of hers to rent this house. weve lived here for 2 years and have complained about the roof, because it leaks all over and has a large hole above one room. i need help. i dont think this is right.and to make matters worse the landlord is my husbands cousin.my husband dont even know because hes out of town for 2 weeks on his job. any advice please help.

The laws of your state govern landlord tenant situations, and also govern the process of eviction. You can't be evicted without an order from a court stating so.

You didn't say if you were current on rent, and/or what your monthly rent is. If you are current on rent, then your landlord must give you a certain amount of notice. You also make no allegation that there is any written lease. If there isn't, then the laws of your state govern how this is handled and what notice is required and when.

If you have not paid rent, then regardless of the situation, your landlord may take action to evict you from the premises. Again, he must file in the appropriate court, must obtain a judgment for possession and then if you don't leave voluntarily, he can have the sheriff come and remove you.

You need an attorney. I would suggest, as others have, your local Legal Aid society, if you cannot afford an attorney. Depending on the city and/or state where you are, you may also find a law school. Most (but not all) law schools operate legal clinics where law students, under the supervision of licensed attorneys, assist indigent clients with legal problems.

If that fails, you may need to hire an attorney, or at the very least, pay for a consultation. If you need an attorney and don't know one, contact your local or state bar association for a referral.

no such thing as a cheap lawyer. try your local legal aid department. Also contact some churches. I was evicted once and it really sux. I feel bad for you. I went to the court date for my eviction and the judge (wasnt a real judge, he was in jeans) treated me like crap and treated the landlord like royalty. The system is not on the small man's side.

Try calling Neighborhood Legal Services. You could also call the State Bar Association for a referral. Explain your situation and they should be able to point you in the right direction.
