It's not so much eBay is getting away with it, as much as sellers that aren't following the rules. If you contact eBay directly, and send them the seller's name/id, they'll jump on it right quick!

Ebay does not list pirate movies - Ebay does not sell pirate movies - Ebay is NOT an auction site. (That's right....it isn't)
The USERS list pirate movies, the USERS sell pirate movies, The USERS establish auctions, Ebay is a 'venue' that allows individuals to sell their goods. eg. You take 1000 pirate DVD's to a car boot sale - it's your *** in court, not the VENUE owners.
Report the USERS to ebay or fact, or your local trading standards

I dont think ebay check every item that goes on, there excuse will be some clause in the sellers agreement with them not to sell copywrited goods.
