It applies to both, there is no excuse for killing innocent civilians just to get a point across. (This also applies to many of the tactics America used in Iraq)

Of course they apply to Hamas and Hezbollah! Targeting civilians is a war crime no matter who you are.

War crimes can only apply to nations with real armies.
