Your lawyer is saying 50/50-why don't you take a house and she take a house. Unless there was a prenup. signed before marriage, she and you get half of everything. Good Luck!
Added response*** Ingrid is stating what I have heard others do. Sell expensive cars for $1.00 and give the spouse 1/2....I can see where you might be tempted to do something like that if you feel she now was only in it for $, BUT you have two children. If you have been the financial support and she's remained at home to raise the children, she will receive child support for your children if they remain with her. Why would she want to divorce you for the money if she still loves you??????? Doesn't she share the same $ you have while married? This part makes absolutely no sense to me......and only you know why you think this.

Laws are different in every state. Professional real estate lawyer or Real Estate Broker should be able to answer this one.
If as a married couple you secured a mortgage on any of those properties and as a married couple you made payments on that, she is entitled to a percentage on the property, not necessarily 50%, but not higher than that.
Get an opinion from a professional in real estate in the state in which the Divorce and settlement will be conducted. Check also with a professional in real estate from the state the properties are located if different from the previous one.
Are there any more properties? In settling the divorce and splitting things between the two of you; you can negotiate (give a little, get a little) to make sure every one gets exactly what each of you is entitled to. Remember, for the sake of your children, you must have to stay in touch after the divorce, this issue should be resolved as quickly as possible in the most amicable way, for your kids not for you.

Are the 2 kids hers. If so of course she DESERVES part of it. It really doesn't matter because unless you two can make an agreement before court she will end up with 50% and if the kids are hers child support and maybe alimony. Why would she divorce you for money? Unless your greedy and stingy she would get more money staying married to you. Sounds like there is a reason- Are you financially abusive to her? withholding and controlling the family funds or maybe she is just a gold digger and when you made a budget it pissed her off to the point she thinks she can buy all the things she wants with the money from the house. If she is a gold digger she will have a wake up call. If your stingy and controlling it will be you who is in for a rude awakening.

First people don't divorce for no reason. The odds are that she has someone else and tells you she still loves you, that could be true but if she did then i would assume that she would not be leaving. Now on to your question. The first house should be yours and if you guys shared the second for all those years then you should split it. If your lawyer can not give you a good answer then you need to find a new one

Does she DESERVE it? No, I don't think so.
Is she entitled to it by law? Unless she signed a really good prenup, YES, I think she may be. But there's lots of options - such as fighting her tooth and nail until she gives up, falls in love with someone else, or runs out of money to fight.

California is a "community property" state, so you are screwed if you didn't have her sign a prenuptual agreement before the wedding.
But can she still divorce you if you won't agree to it? Refuse to sign the papers.

Prenup, but its too late for that. I guess you just have to take your lumps, you got married in a community property state and if you were worried about the property you should have protected it.

MONEY DOES NOT BUY HAPPINESS and she is just selfish and belive me her time will come be calm dont get to worked up its only money as long as you have yourself, children that you love and you can provide for them and food and shelter then thats all that matters good luck
