the owner of the mobilhome court where i live at informed me starting august 1st all those tenants who don't keep there yards clean of weeds and in general clean of junk will be charged 40.00 if the court has to do this said work and if a said tenant don't pay the 40.00 charge for the court doing the said work then that said tenant shall recieve a 30 day eviction notice this new rule by the owner wasn't submitted to anyone who lives here in writing we were told verbal is verbal just as binding legally as writing?

Is this the owners decision, or is he just passing on a city ordinance? Many small towns and cities have adopted this procedure in order to help with both health conditions and the way their city looks. If It is the city or town. It is perfectly legal and they do not have to give you written notice.

Where do you live? I found this regarding Washington state mobile court laws:
Enforceability of rules against a tenant.
Rules are enforceable against a tenant only if:
(1) Their purpose is to promote the convenience, health, safety, or welfare of the residents, protect and preserve the premises from abusive use, or make a fair distribution of services and facilities made available for the tenants generally;
(2) They are reasonably related to the purpose for which they are adopted;
(3) They apply to all tenants in a fair manner;
(4) They are not for the purpose of evading an obligation of the landlord; and
(5) They are not retaliatory or discriminatory in nature.

Why are you stumped? Should the legality of it be the issue?Clean your damn yard and have some Pride! Come on do you have to fit into the stereotype? Should someone tell you to clean up and live in a community?
You give all of those people that look down on "trailer trash" justification for doing so. If you don't want to mow a lawn or take care of your property then rent an apartment and have them do it.

No verbal is not as binding as written and signed statements.
Your out is that he never told you personally.
But just to be on the safe side, keep you yard clean and you won't have to worry about it one way or the other.

I would say they need to do something in writing unless there is a pre-existing city ordinance regarding property upkeep. If there is, the owner may be within their rights to do your job for you and charge you for the service. Otherwise, they may be facing a fine from the city, themselves. Why don't you just clean up the yard?

dont know about the legal aspects of the verbal/ written thing, but wouldnt it just be easier to weed eat the weeds, and clean out the junk?, I would like to have a nice yard.

The verbal notice is legal, but it should be backed up in writing. I recommend you consult the Landlord Tenant Act for your jurisdiction.

No. He is changing the terms of a tenancy, which in most states he cannot do unilaterally.
Unfortunately, the proper way is to send you all eviction notices and ask you to sign new rental agreements containing this requirement.
Except for persons who have leases or written agreements that have not yet expired.

Verbal is binding only if agreement is reached. Someone can't tell you something and that makes it a binding contract.
