My husband wants to keep the house but since we filed bankruptcy (chapter 11) to pay for the house, I am concerned that if he later defaults on the payments, the mortgage co will come after me. I don't know what to do other than make him sell the house.

You are asking for legal advice from amateurs and the answer also depends on which state you and your ex reside in.

It is illegal for anyone without a law license from the state he/she is residing in or practicing in to either offer or sell you advice.

You are really setting yourself up for a lot of misery by trying "cheap" your way into a solution.

Go find a good attorney who specializes in these things--your state bar association has a list--and hire that person to advise you.

You really need to discuss this with a lawyer. There is something called a "quit claim" that can be filed to get the house out of your name, but that may not discharge the debt.

Lawyer. They'll give you the best advice.

Some states views this as community property between husband and wife. If you live in one of those states the house will be sold and any proceeds from the sale will be split between the two of you.

If you agree, the house can be changed over to his name. You won't be held responsible after the divorce.

if you already paid for the house, how can he default on payments? unless i am misunderstanding your question.

get the home appraised. split the appraisal value w/ what is owed on it and have him buy you out. then get he loan documents transferred to his name only.
