You mean she has become a bigamist? I assume. This is not a minor issue. She faces charges for marrying you, and he (the ex) could force the issue... Check with the state law of the marriage, and it is time to consult an attorney as to how to handle it. He might have filed, and has she signed a waiver to appear in the previous marraige... if so, she will be protected, because it was his responsibility to file the papers then. As for paying, the 7 yrs you have been married, you have filed as joint correct? If so, then it is not just "Her" 401K, the amt in it and contributions to it, are a 50/50 split for the 7 yrs of the marriage. But to get out of it, YES, make it come out of the 401 K if you do not have to close it, and can borrow from it without having to pay taxes on it.
Lots to consider but I am fighting one of these similar situations, and my attorney is advising the above.

Take her for everything she has. She wants a divorce from you now after 7 years because she is still married to him. Well bigomy is good grounds to bust her butt in court and bar b que her a**. Do it to her man. She sure will do it to you. Women have no heart in court.

Well, she is your wife....you should help her pay for it......since you and her are no longer 2 different people but 1 couple. You have to share each others problems.

let her pay it out of her 401k, its a very cheap price to pay for freedom from a bad decision in her past. don't be devestated, it was a simple mistake...

She sprung it on you and yet in another question you say you have cheated like 40 or 50 times? Yikes. Don't play poker anymore with her.
