I reported to Ebay, but it doesnt work, becuase she charges most of her items on shipping heavily, so the real amt of the items is small, Ebay would not deal with the purchase protection thing, I want to write her a legal letter, are they anyone know how to do that? thanks

There should be a link on ebay where you can report ebay abusers/fraud.

You have a number of options:

1) If the money order was sent through the US Mail you can call the Postal Inspection service. You should especially do this if it was a postal money order. The Postal Inspection service will investigate this as mail fraud.

2) You should try calling the seller during business hours. If you cannot reach him, you should leave a message with auction number. Do not threaten, just say that you haven't received the item, you are concerned and would like tracking information so you can work together. If he/she thinks you are working collaboratively to solve the problem, he/she is much more likely to work with you.

3) You can file a report with eBay. Your transaction may be insured. Check to see.

4) You should continue to contact the seller by email. You should use their direct email, but also email them through the eBay email system.

5) You should not leave feedback until you have exhausted all possibilities to avoid the seller taking an action out of spite. You may, however, wish to view their feedback and see if the current situation is consistent with the seller's feedback; this may give you a sense as to whether this may all be a misunderstanding.

Have you contacted EBay to let them know?

To protect yourself now and in the future from getting ripped off, I would suggest a Pre Paid Legal plan. Not only do you get access to a local attorney firm, they write these letters on your behalf, make phone calls. Cover you in court if you're sued, help keep points off your driving record and assist you if audited, they offer all other services at a 25% discount....at LEAST. All of this and more for less than a dollar day.

Take a look at http://prepaidlegal.com/hub/cdmallicoat for more information. I have the plan and the attorneys cleared up a derogatory mark on my credit that shouldn't have been there!

Good luck.

Check ebay's FAQ or contact them. How likely is it that you are the first person to ever have this problem, really? And this is why on the sixth day god made paypal, by the way.

Go back to the e-bay website. They have instructions on how to handle these situations. Good luck!
