My wife and I are having some problems and I think that we need some time apart. Maybe by being apart we can see how much we really miss each other. I told her that id move out for a while to give us time to think about our marriage.

Legally separated shows that both parties have agreed on the conditions of separation and has done so legally which leaves very little room on when or how long you all have been separated which is very important if you plan to use it for a uncontested divorce.

Separation is basically your living apart and no other decisions are legally documented as it pertains to the home or children its just someone moving out but without a legal separation it can stall a divorce because two people can disagree or even lie about when you actually separated.

Don't separate just to see how much you miss each other because that doesn't resolve anything but create a further mess in your marriage.

Don't always think absence make the heart grow fonder because time and time again you see separations leading to relationships with other people.

Separation should only be used as a stepping stone to a divorce
not to see whether your going to be miss while your gone.

Separated, is a verbal agreement, between you both.

Legally Separated, is a contract drawn up by an attorney, stating custody of children, division of real property, division of possessions, alimony, and such, and is agreed upon and signed by both parties. Usually costs between 300 and 750 dollars depending on state and attorney. This is filed with the court system.

Either way, this does not mean that you can not get back together.

Most states will consider your separation prior to divorce, as both of you live apart in separate housing. You, for the most part, can still have sex as a couple without having it detract from the separation period prior to divorce.
Check for your state guidelines for divorce.

If you separated you it's probably consist of you guys havin some time apart. Legally separated it's like a divorce.

a legal seperation is where you actually FILE thru the court system that you are looking to divorce each other. just being seperated means you live apart from eachother without involving any legal documents

That--and legal separation means the two of you do not benefit from increases to the other's wealth. I.e., you file legal separation, and then you get a raise. Your spouse's coummunity interest would not reflect that raise.

I am sorry to hear about your difficulties. Legal seperation requires filing documents with the court. This is to prevent the liability for bills that your spouse incurs during a seperation.

Being legally separated means saying bye bye to your savings in bank but being separated means you can still save it..!

separated - you can be legally responsible for her bills

legally separated- you're able to get a document indicating responsible for your bills/debts only.
