Are you a citizen of the United States? If yes, good. Have you lived in NY more than 6 months? If yes, good. Then proceed to a local divorce attorney, or you can represent yourself. File for divorce. Serve his last known address with papers for divorce, make sure it is registered mail, he has to sign for it. If he is served over and over, and doesn't sign for it, then that is also acceptable to the courts. The attorney will hold that proof for you. When you go to court, if he doesn't show it will be uncontested, voila, you are divorced. Although he could show up, you would still get a divorce, but he may want his property back. Stuff like that. I don't know what the separation time is but you can look it up online. Good Luck!

Check the laws, but you should be able to put an ad in the newspaper for I believe 4 to 6 weeks notifying him of your intentions to file for divorce, make sure you get a receipt from the newspaper showing that this was done, if he doesnt reply then you may file, go to officemax and get a divorce package and file it yourself, a none contested divorce should be very easy for you to do yourself. If your residence is in New York, you may file your divorce in New York state courts.

go ahead and file the papers, after about 5 years you can go before the judge and it will be finalized
