In the US on June 27, 2003, in a majority decision the United States Supreme Court ruled that it was unconstitutional to criminalize any type of homosexual (male or female) sexual act or displays of affection.
This decision placed the GLBTcommunity on EQUAL footing (not "special" as many ignorant, malcontents would pose) with heterosexuals.
The landmark case was Lawrence v Texas.
Prior to the Supremes decision, several states retained the right to prosecute homosexuals, and in many cases the defendants were sent to prison. One, or possibly both, plaintiffs in Lawrence v Texas did spend time in jail after police officers invaded the apartment of one of the two and witnessed sexual activity between the men. The were subsequently arrested, successfully prosecuted and jailed. The plaintiffs took the case to the Supremes and won the majority opinion, thereby making history for GLBT equality...in a sense. Of course we are still denied EQUAL ACCESS to federal benefits and obligations such as those now enjoyed by heterosexual married couples.
