i have taken all the lies that i can take. it's been a sham and i don't want to be the sucker anymore. how do i go about divorcing her? just have her served one day or talk to her about it? note: she will probably not sign as she will try to string it out for her Green Card. i don't care anymore...she can keep it...she earned it...that an Oscar for pretending so well. there is nothing to salvage as it was a set up from the start...she saw me coming a mile away. God help the next poor bastard that she meets.

no property no children. 10 month marriage. i am afraid that if she finds out i want a divorce she may leave and i may not find her to serve her.

she does have her conditional GC...but i think that goes away because it's under 2 years of marriage.

find a good lawyer to start with...I'm not sure about the details, but there is something you can do (used to be able to) about posting an ad in the paper, and if she doesn't contest it, it won't matter if she signs or not (that may only be for when you don't know how to get in touch with your spouse...like i said...i don't know the details). Depending on the case, though, the judge can grant you a divorce without her signature.

The best way to start this situation is to find a GREAT attorney and let them handle this for you. They will know what to do and not to do since she has not got her Green Card yet. I would say don't tell her that you are filing for divorce or yes she may run and it will delay the process. Good Luck!

How you handle to divorce is based on what you feel the end result will be. In all cases I would suggest an attorney first. I tryed to work it out with my ex-wife and tried mediation and then found out she had an attorney before I did and all she was doing to trying to insure she got what she wanted (ie.. all the money and none of the bills and maximum child support).

Sorry you got took. If there is only minimal property and no minor children, go with the quicky divorces they offer at legal clinics etc. You don't need a lawyer. I got mine with the help of a legal aid who did all the actual filing. Wham bam, $365.

I work for an attorney ,get with an attorney for a consultation, he will give you options as to how to proceed .you are not alone and you need advice so that you know if your finances or property will be affected and how to act on that, but you need to go to a family practice attorney at law.
