This is what is commonly known as the yellow and Black Argiope. (Argiope aurantia) it is quite common and dont worry it is non-toxic. It could give you a little pinch, but is not at all dangerous to people. It is my all time favorite spider, they are very beautiful, I have one as the background on my computer right now actually!! hahaha.
They belong to the family Aranidae, the orb weavers, they make the typical round orb webs, that look like a bike rim. They are fabtastic to have in the garden, 1 for their beauty and secondly, they will eat tons of mosquitoes, they do wonders as biological controls for biting flies.

This is the Golden Garden Spider, Argiope
aurantia. It is a common eastern North American
spider, especially in damp places, mostly in the
open, though occasionally in wooded areas also.
There is a similar somewhat smaller species in
many areas of North America and other places,
the Banded Garden Spider, Argiope trifasciata.
It has narrow black, white and yellow crossways
bands dorsally on the abdomen.

looks like a garden spider. The black and yellow argiope. It is an orb web spider ( type of web...round in shape. Pretty cool

A garden spider, They are not dangerous. Actually beneficial in the right location. I have kept them as pets when I was a kid.
