Ok... My ex was married, and he was behind on child support.
so the IRS has taken his income tax check and is holding it. They sent it to the child support office and they said, they have to hold it for a max of 6 months incase the person he filed with ( wife ) wants to contest it. She has called childsupport and stated she is not contesting it, and they still won't release it. I've even called the child support division in Virginia, where this all originates. I need the money now, so I don't understand if the rule is to hold it for 6 months incase she contests it, and she's not contesting it, why they won't release the funds to me. It's very irritating. Anyone know what the next step should be?

By the way, the withholding on his tax refund is called a 'Tax offset" and I've looked everywhere on the web. I don't know who to contact to get this rule revoked since she's not contesting.

website for child support laws in state of Virginia. Find out how the child support laws are applied in your state and if you still have a valid complaint, go through the complaint or appeal procedures as prescribed.

You can get in contact with the State's main child support office and speak with the person in charge of the offset unit to get some answers....
It is true that the reason there is such a long wait for joint returns is because the spouse should not be responsible to pay for the non-custodial parent's child support so we need to give them time for the spouse to file for the injured spouse claim form BUT if the spouse has contacted the levy unit advising them she wont contest the action the release of the money should be before the 6 months... Each case is different and paperwork does go missing every once in a while and some workers are faster than others so contact your local child support office or the state office for specific answers and dates.
