It depends. Some states have laws that allow for the child to be legally consenting at 16 and even 15. Some go as high as 21. In most states, if the older person is over three years older than the younger party AND over 18, then that person can go to jail for statuatory rape. Statuatory is a longer version of the word statute. Statute means limit.

If the younger people are over 18 years old, then it's called Sex. If the younger people are under 18, and the older people are over 18, it's called statutory rape.

If you are over 16 in Ohio, you are considered over the age of consent. If the person is over 18 and the other is 15 or under, it is statutory rape. But if the (victim) is 16 or older and agreed to have sex and didn't try to stop it, there is no law. Age may vary from state to state.

If the younger sex partner is below the statutory age (usually 18), then it's statutory rape, a strict liability crime.
However, if the partner is over that statutory age, then it's called exercising your constitutional right to privacy, and anyone who doesn't like it is likewise free to mind their own business.
