This is the law in Texas (I have cut out the irrelevant bits):
"§ 21.11. INDECENCY WITH A CHILD. (a) A person commits an ooffense if, with a child younger than 17 years and not the person's spouse, whether the child is of the same or opposite sex, the person: (1) engages in sexual contact with the child or causes the child to engage in sexual contact; [snipped]

"(b) It is an affirmative defense to prosecution under this
section that the actor: (1) was not more than three years older than the victim and of the opposite sex; [snipped]

"(d) An offense under Subsection (a)(1) is a felony of the second degree and an offense under Subsection (a)(2) is a felony of the third degree."

Roughly translated...you are too young to legal consent to sex and the only possible defence he might have made was if he was within 3 years of your age AND you were at least 17. He is 21 and you are 15...that is a six year difference (and you are under 17)...basically, he is going to prison...which is where he belongs.

Also, there is a duty to report in Texas. Anyone who knows you are underage and pregnant must report your "statutory rape"....this includes medical doctors. The authorities can compel your testimony and they will use the evidence of your baby to convict him.

As for how long can they keep him in prison? You are in Texas...they do not look kindly upon child rapists (you are legally still a child). He will go to prison for a very long time and if he ever gets out, he will have to register as a sex offender for the rest of his life.

im not sure of the laws in texas exactly, but where i live if you get pregnant by anyone over 18 and you are under 16 it is child molestation...i had my first daughter when i was 15, her dad was 25 at the time, but my parents did not press charges and the state never picked it up. where i live, not only can the parent have him thrown in jail, but the state can also choose to press charges on him even if your parents dont.as far as how long, i dont know it probably varries with everyone. i wish you the best of luck, your future is a tough one, iv been there and am still there, but i would not trade my daughter for the world...if your undecided on weather to keep the baby...please dont have an abortion, when my daughter was 6 months old, i was 15 lbs lighter than before i got pregnant, and everyone said i had a better figure than before...thier are many people who would love to adopt your child if you cant keep it and your too you7ng to regret an abortion for the rest of your life.

if you want to ask any questions or anything IM me...
good luck to you.

More than likely your dad could have him arrested and sent to jail. There is also a possibility that your dad won't even have to do it..the authorities may do it on there own. Some states have a law where no parent has to charge the adult male with it, they can just arrest him once it's found out.

Have you talked to your dad yet? Is your boyfriend going to stay around and help out? I sure hope so.

I also hope that you quit having sex for now. You are too young to have to be dealing with all of these consequences. You should be out having fun with friends your own age instead of worrying about if your boyfriend will be arrested because he got you pregnant.

Just because you've had sex once or more, doesn't mean you have to continue. You can quit at anytime. You don't want to end up pregnant or with a STD. The only thing that is 100% safe is not to have sex...period.

Good luck to you and your baby. Sit and talk with dad and try to get everything straightened out.

Yes, your dad can press charges and he should go to jail. You're too young now to know how he has ruined your life. You are still a kid and childhood is short enough! I wish you well with your pregnancy and with the baby. Don't spend too much time worrying about this pervert. Even if he gets out in 1 year he will be on to other GIRLS. It's not exciting for a pedophile when the little girl has a new baby to take care of. Sorry.....

Yes your dad can make him go to jail. I'm not sure what the time limit is in Texas, but I know of a boy who went to jail for 8 years in Indiana.

You are a young and beautiful person. What you need now is help and love. Not opinions!

Whether this person must go to jail is important to you now but what about in 2 years after he has already been gone for 15 months? Think farther than your emotional attachments.

Again, get some neutral help!

yes your father can file charges. It all depends on whether or not you consented to having sex with him on the outcome. If you did not consent to this then it is considered rape and he could get 10-15 yrs in the pen and a fine up to $100,00.If you say that you consented to it and wanted the sex also then he will probably get a year or so on probation. If you do not want to press charges and you plan on marrying this guy then you could tell your parents that you are pregnant but don't tell them by whom.Give them some time to cool down then tell them you feel that you should get married and raise your family. In Texas,it is not reported to the laws on cases as this one unless either you or a family member chooses to press charges. It is required by law for the hospital to report rape victims.

Good luck and I hope you make your choices wisely. Please consider whether this guy is planning on getting married or leaving you and whether or not he intends to pay child support and help you raise this child.

god bless you

Darling,

statutory rape in Texas is below age 16, same as Oklahoma. Your boyfriend has shown he can't be trusted. Please get the state of Texas behind you. Even if they don't put him in jail, he got to help out with the child and we sure don't want him trying to do this to someone else. Just dial 911 with or without your dad.

Yes and he should. When you have that baby, you'll realize that it's childhood is priceless. Your's my dear has been spoiled early. It is possible for a young woman to raise a child on her own. Make sure you complete your education. Having the boyfriend that preyed on your childhood behind bars will allow you to achive your goals distraction free. I don't know how many years he would get, or even if it would be a jail sentence. But he needs to know he did wrong, and that he needs to get interested in women his age.

In the state of FL. it is rape and he'll go to jail. Maybe not a long time but that point on hell be considered a sexual predator in all fifty states. Also child services may be called to investigate the incident also.
