A man and woman are in a relationship and have had sex. They are having relationship problems and the relationship is on again off again. It has been two weeks since they have seen each other.
The woman calls the man late one night and asks him to come over for company. He comes over drunk and wants to have sex. He's drunk, but calm and friendly, not agressive. She doesn't want to have sex, just wants his company. They go to bed and she's wearing pajama bottoms and top. He forcefully removes her pants, holds her down, and has sex with her. She says no and stop over and over again and pushes her off, but he continues to have sex with her. Is this rape?

Any time a woman says no and a man forces himself on her it is rape in my mind. It doesn't sound like a very good decision to invite a drunk dude over late in the night let alone a good decision to get into bed with a drunk dude and not expect to have problems. Just cuz he was drunk doesn't make it ok either.

It is rape ( but you knew that) I think that your question is really about how successful she would be in charging him. Truth is probably not that successful. Rape is hard to prove when there are witnesses, bruises, and semen samples. That is reality.
But I would like to point out that this rape is probably only one small part of the big picture...this is clearly a situation of domestic abuse...Husbands and boyfriends do rape their partners...and it looks like it is escalating...It usually follows a pattern..where things get worse if she tries to break up with him. And, the truth is, lots of times the woman asks her abuser to come back for her own reasons...

Yes, definitely this is rape. She said no. He held her down and forced her to have sex against her will. Call the police and have this man put in jail.

Yes it is rape. A man who is married to a woman and forces her to have sex can be charged with rape. So he definetly could. Just b/c she has had sex with him before and invited him into her house does not give him permission to force her to have sex.

It's absolutely rape... whomever this woman is should get away from her boyfriend and report the incident. His being drunk is absolutely no excuse for rape... there is no excuse for something like that.

If a woman has an es-husband, and he does this, it is still rape, even if at one point they slept together every night. No is no!!!!!!!

Um, yes, I would get out of that relationship ASAP or call the authorities if it got worse...but considering he was drunk, there's no telling if he wouldn't do it again...he will probably regret it once he's sober

i think it's not a rape coz she who called him and made him drunk,besides they already have had sex.if she didn't want to have sex, why she allowed him to go to bed with her,i don't think she wanted him to tell her a story .
it's her fault,coz he was under the effect of alcohol.& usualy a drunk man is worse than an animal.
