The judge can decide for either parent depending on many factors, such as where are you going to live? Is this parent able and willing to take care of you? Is this parent the best option for you? Income is important, Maturity on the parent, Can the parents communicate effectively, so they can together take care of you.
As for what you want, it will depend not on your biological age but your maturity. Can you help the judge and your parents decide?
If your parents have each hired an attorney to represent them, you can talk to either one about what you want. Talk to both your parents sit down with them and together you can make a decision.
In some states you can have an arrangement in which you will spend the same amount of time with each parent, maybe this can work for you

Depends on your age, most states I think the age a judge would consider is 12, but if you have concerns about your mom and this guy u need to talk to your mom and how you feel. It is hard enuff to be going through what u r going through, don't hold things in. Hopefully you are able to talk to both your parents about your fears and concerns without them going mental about it. IT is also probably hard for u to think of your mom with someone else, so definately talk to her.

Usualy a judge will talk to children to find out what they want. They will try to choose the best person for you to go with.
If there is a reason why you don't want to go with the boyfriend, you should tell your mother. If you just don't want to go with him because you don't know anything about him, you could ask your mother if you could meet him.
I hope everything works out well for you. It must be kind of scary.

If you are over 12 and the parent you choose doesnt have any criminal background or any history of drug,physical,mental abuse then there should be no problem with you living with that parent. Good Luck sweetie

It sounds like you're the age that you are still living at home? Am not sure what choices you have, you might want to ask or talk to your mom or your dad about options.

you can tell the judge i want to be with her but not her boyfriend and but i rather to live with my dad becasue he not seeing anyone and I don't feel comforable with him and Don't now her boyfriend what he is? rapies, or like to do with little girls. or what I don't know his back ground. And I will not live with mom if she live with BF.

talk to your mom sweetie. if she doesnt lose this guy after you talk to her you tell the judge you want to live with your dad. and tell him why. expalin you have talked to your mom and dont want to live with this new man.
