I am currently 6 wks pregnant, and having a very hard time with dizziness and abdominal cramping. I have a history of miscarriages as well. I work a job that is extremely physical, and involves alot of heavy lifting, pulling, and other strenuous activities. I am worried that when I tell my employer about being pregnant, they are going to fire me, or demote me. What are my legal rights as far as not being able to do the lifting or other things I could do before? My doctor tells me to take a vacation for awhile, but there is no way that can happen. Any ideas on how to handle this?

you might want to find another job that doesnt require such physical requirements...you will be better off if you do it now...other wise you'll prolly have back problems later in pregnancy...and if you have a history of miscarriages the lifting your doing might not be helping...you might be putting too much strain on yourself....as of the laws...im pretty sure they cant fire you for being pregnant but demoting i dont see why they wouldnt be able to...especially since what you do could be considered a risk to your pregnancy

If your employer fires or demotes you, I would get a lawyer. They cannot fire you for being pregnant. . . it's part of a woman's life. If you get demoted, there really isn't a whole lot you can do there, as far as I know. Only thing about that is, they cannot lower your wages in most states, once you acheive a certain level of pay it is illegal to lower your pay rate.

They can't fire you for being pregnant. They can however fire you for not being able to perform the job functions required. Maybe you can work with them and find a position better suited to you condition. If your doctor feels you need to take time off, he can put it in writing and then you will be able to obtain unemployment benefits from your state or possible fereal assistance.
