My question to you is also "Are you legally married?"

Check with your local courthouse, wherever you were married, and/or the local Legal Aid office.

Same as everyone else.

The marriage is valid, unless it was deemed fraudulent (for citizenship), but typically the civil courts will deem it valid unless the issue is raised. The fact that your spouse was/is an illegal alien at the time of the marriage in and of itself does not make your marriage void.

I am a lawyer in Florida. There is a lot of that here.

I am surprised that your spouse did not file the immigration appropriate papers when you got married.

If you were an American citizen when you married him/her the marriage is valid and they too are an american citizen by proxy If I'm not mistaken.

In that case, a divorce would be conducted as usual.

If he's not legal and you got married in America, there is a possiblity that your marriage isn't legal. But check with an attorney in your state.

Otherwise, I would think you can do the usual divorce.

You have to have the divorce in the country where you got married. If you got married in the country you are in, the person would not be an illegal immigrant

Most of the answers you have here are pretty good, however I recommend you seek legal counseling.
