That vacation time is yours, you earned it. If they refuse to pay you for it, they can get into serious trouble. If you have anything in writing staing the terms and conditions of the vacation time, i.e. "X" number of days or hours earned after working so long. If there is anything that states you are entitled to vacation after a set period of time, then once you work that time, you have earned it fairly, and they must pay you for any unused vacation.

Let them know that you intend to fight for this money due you. You can contact the Fair Labor Relations Board and file a complaint.

It is not required by the employeer. It should be stated in a policy manual or hand book how vacation pay is handled after termination. Try looking there.

Unless you are a contract employee with a specific clause regarding vacation time and unused vacation time, then yes, they can. Plus, if you were terminated (ie: fired) it was for a reason... they are not going to give you anything extra. You should have used it up beforehand!

The laws may be different in your state, but in Florida, vacation is a benefit, not a requirement, and as such, termination would disallow such perk. I hope you can win your case tho!! Maybe an employment attorney would be able to advise you of your rights in your area. Good Luck!!

I don't think that is legal, but you should check your state's laws to be sure. In Texas, unused vacation time must be paid whether you quit or are terminated.

There is no law requiring them to give you unused vacation time. Your contract may contain provisions regarding this.

If you were terminated for certain reasons- they don't have to give you anything. If you resign on good terms- they should.

I would say that it depends if you voluntarily quit or were fired. But he is right, you could have signed it away.
