In Missouri, if the truck is moving then yes it illegal to sit in the back of the truck.

yes it is.
the law in california allowed it the 80s until they did demostrations and reports of people falling out.
i think they allowed it for a while after that if you had a camper shell on.
then they found that you still hit hard things in a emergency stop, you just dont fall out.
