the house is really in my husbands name but we want out because his brother in law and sister are not making payments on time they always late and our credit is in bad shape.. its someone out there can tell us what to do? can we sell it?? they made a payment on the 30th of the month and the payment was due on the 1th,, they dont care about our troubles and we cant even get a loan on our own home..we want to sell the home or they can put it in their name can it be done?? we are so confuse because we never been in a situation like this..someone please tell us something..we dont get anything out of the deal just the bad credit.

ok guys im not getting the answer i need.. you see the house is in my husbands name but he did that for his sister,,they use the house for mentally ill people like a group home.. they had two houses one in their name one in my husband name. we did not purchase the house they did but in my husbands name.. they lost the house they had in their name.. now the one in my husbands name is all they got left but they still pay late and our credit is bad because of that. can we sell it even though that they use it for handicapped people?? is a goverments business isnt it?? we just want our name off the deal because we dont get nothing out of it..... thanks for your answers you guys.

As long as you give them a (writtin) 30 day notice (keep a copy) to get out then you can sell to anyone, if they are still there after 30 days it is illegal, if one of your family members wants to buy it then you need to get them to the bank for a loan. OH ok I see what you mean now, they baught it but it's in your husby's name....It's still youe husbands, and the fact that there are hanicapt people living there would make it your responsibalty to house them, I know it doesnt seem fair but you legally cant sell it OR transfer it to your family's name unless your family is willing to buy it from you. If they are not then you would have to try and find another buyer who would want to take over the business....I hope this all makes sence :0

The owner of the house (the person whose name is on the deed) is the rightful owner and can put the house on the market for sale at any time. The renting party needs to be given notice that you intend to sell the house. Why would you want to transfer the title of the house to a deadbeat renter? If the deadbeat wants to buy it, they can do so through your real estate agent.

there are many places that will buy your property. but you would have to be crazy to just give it to two useless people that will probably loose it in a short time. there are places that will buy your contract or mortgage and then collect from the people in the home, if they cant pay they get removed.. and you also can evict some one yourself for non payment.. family or not you do not have to tolerate such behavior from a renter/tenant of your property.
