It is a violation but if the employer pays within a day or two the Departmant of Labor (DoL) will not expend any resources to fix it. The DoL looks for people who never get paid, get shorted on overtime or get misclassified to avoid paying OT rates. But it sorts cases based on damages, so a day or two late incurs only a small monetary hardship and the DoL prioritizes it accordingly.
Spitting on the street is illegal, too, but try calling the local police to come out and start an investigation. They may even get annoyed with you.
Take a look at the DoL website; without a labor contract, employees are pretty much stuck. Are there better jobs out there? Monster, Jobster, Yahoo jobs (mustn't forget to plug Yahoo products...) may help. If this company is on the edge, you never know when NO checks will get issued.
Also, does your company offer direct deposit? That works for me. It's automatic and does not require payroll to be around.

My husband used to work for a magazine where the employees would literally have to race each other to the bank because they knew not all of the checks would clear!
I don't think it's really illegal but, as some of the others have said, it's definitely unprofessional. You're husband should just find another job. Most states do have laws about an employees' last paycheck. In my state, if you're fired, they have to have your last check ready within 24 hours. If you quit, they have to have it by the next payday.

it is certainly a bad business practice at the least. you and your husband should be concerned with the stability of the company. also, nonpayment could be tantamount to a breach of contract, however, the company cured the default. if the company is having financial problems and they file for bankruptcy, employees are high up the chain for payment, but who wants to be around when that happens.

It depends on what the state you are living in. As long as they are going to pay him there is nothing illegal about it. If they just flat refuse to pay him then it's illegal. If you want to complain about them go to your state Department of Labor and tell them what is going on. They can tell you if they are in violation of any statutes.
