If you can prove paternity, you can contest the custody decision in court. It will be a little more difficult to obtain custody if you weren't married, but it IS possible, especially if you can prove that she is unfit for any reason. If you don't get sole custody, you can try for joint custody, in which you share in the decisions about the child's welfare. At the very least, if she asked for court ordered child support, you can request court ordered visitation. If she backs out on letting you see your child if it is court ordered, then she will be the one in contempt, just as you would be if you didn't pay her. Good luck.

All states are different. In California, you have to go to what's called is a family facilitator. You sit down with your gf and the facilitator. Are you on the birth certificate? Does she carry your last name? You will have to prove paternity, then they will sit down with you and discuss child support and visitation. Then you have to tell them what you are looking for in taking care of your child. Tell them you want joint custody, where by the way did she take the baby??

As long as you did not forfeit your parental rights, you can fight for custody.
