In most states the staute of limitations on these types of claims is 3 years. If you collected from your insurance company then you probably have no basis for filing a suit. Your insurance company would be the oine to sue. If the other party was uninsured chances are the insurance company won't sue them. If the insurance company did file the suit and the other party could not be found a default judgement may have been entered against the other party because they failed to reply to the lawsuit.

All states have a statue of limitations, and they vary- 3 years is common- You Insurance Company may have filed - check with them. In most states now the Under Insured and Un Insured pool will pay your claim.

I don't know what the statute to limitations is Missouri, but in most states it's 7 years. But to be safe, check what it is there. That's how long you have to re-file your suit.

It depends on the statute of limitations in your state. Your best bet is to call an attorney just to find out. Usually you can get answers to procedural questions like that from the receptionist. Good luck!

Your action probably would looked at as a stale claim an thrown out of court.

Possibility, a discovery could bring you back in within statutes of limitation but don't count on it.

The expense would be great at best.
