Our mother was very sick. I was her personal nurse for alomst two yrs. until she passed. One yr before she died, we (my brother, sister and I) transfered the title of her home into all our names. This was so we wouldn't lose it to a nursing home if she had to go to one. I had been living in the home for 5 yrs. already and then care of my mother for almost two more yrs. until she passed. I am now paying all bills here ( there is no mortage). My brother ans sister expect me to pay rent to them. And also my sister wants me and my 15 yrs old son to just pick anf leave the house after living there for 7 yrs. What are my rights?

I would consult with an attorney on this one.Yes they have rights to the house since it is part theirs also but no I do not feel that you owe them any money for rent.If they plan on renting it out then you are entitled to 1/3 of what they receive for rent.If you take it before a judge,He/she will probably order that the house be sold and the money be divided 3 ways amongst you and your brother and sister.If you do not want to loose the house then it would probably be best for you and them to come up with an agreement as to what to do with the house.If you all agree to rent out the house and an amount and you want to stay then you should only owe them each 1/3 of that.

You own a 1/3 of the house, being a owner they can not kick you out,

On the other hand the other two siblings also have a right to use the house on a equal bases with you

The other two can either force a sell of the house to collect their portion of it's value or since their is no mortgage can you go and get a note and use the money to pay off the other two siblings?

If your name is on the title of the house, you own it too. If you have proof that you were there for the amount of time you say that you were, then they have no say since you were there prior to it. If thier names are on the title too, in actuality, no one needs to pay rent because it is everyones house. You have the option of selling your part of the home, but if you're paying thier way, and they are being selfish, I say get a lawyer, or take them to court and make them pay thier part of the bills. If you want, try and buy her out.
It's a tough situation, but I'd consult a lawyer and see what he thinks the best course of action might be.

If the house is in all 3 names no you don't have to pay them rent.. The end result will probably be to sell the house and split the profits between all three of you..But no legally you don't have to pay rent and since the house is in your name too they can't make you leave

Also you may have more rights since you are paying all the bill's try getting a lawyer

I can't forsee any way in which you have to pay rent if you're on title unless the property is in a trust and you're a resident beneficiary. You don't even have to sell your interest in the property. However, I suggest you get a real estate lawyer to protect yourself and/or know your rights because your siblings may be able to get secured loans on the property (depending on how you three hold title).

Keep in mind, they have access to the property as well and can live there too!

dont move look up the laws in ur state u may have more ownership then u think & u most likly dont have to pay rent
