Sorry got the months crossed, resubmitting question

Got one month behide on June 06 rent payment. Paid July 06 payment plus additional 100.00, to help with Junes rent landlord said that would be fine, but try to get caught up as soon as you can. Been liven In same place for over three years and this was the first time I got behide. landlord said I have been good tenate and does not want to lose me as a tenate and will work with me to get caught up. The next day landload gave me three day notice to pay or vacate. do not have the money to pay right now, Is there any legal help for this?

1st call the landlord and ask if there is any way to work out a repayment plan to have you caught up within 2 more weeks. If so have it put in writing. If not check with you church to see if they can help or Salvation Army will help sometimes. Also check with your family for a short term loan. When you paid July 06 rent that was really June's rent and $100. towards July's rent.

I varies by state how soon they can give a vacate or pay notice Check onthe web by 'Tenant rights (your state)" this will help you see what you can do.

this isn't legal advice, I'm not a lawyer- that being said, it is my understanding that a demand for payment of rent or posses ion is the first step required in order to get an eviction into court. If you don't pay the amount owed then the landlord has to file for a court date- that may take a day or two, or possibly a week or a month (depends on the docket availability in your jurisdiction) when you go to court, the landlord has his say, and you get your say (you may have to file a response in writing before the hearing- depends on local rules, etc.) you can make the claim that the landlord agreed to the late payment, accepted the money for July plus the hundred and therefore he acted to modify the contract (lease) and that since he did so the contract being modified you should not be penalized- it is also probably a good idea to show up in court with some kind of payment (certified funds- like a money order) so that you can make the claim that you are entirely willing to continue the modified contract and have a good faith payment in hand which you are willing to turn over to the landlord assuming the contract is to continue in it's modified form.

It is supposed to be a five day notice to pay or Quit.not 3. Call renters advacate. they can more inform you. just dial information and they can get you the #. Also try job service or your local welfare or state agency. They have funds for people who have temporary hard times. Tell your landlord that you are going to take the notice to these people so you can get his money. you need the notice,his name and phone #. also proof of income. Dont tell him its supposed to be a five day notice,you can wait for court for that, If it goes that far, It probably wont. Your Land lord is supposed to do everything by the book and if he dosent, its thrown out of court. You can alse look on the internet for info on Landlord and tenant law. Next step is he would have to get a court date to evict you,which will take a while.and the judge will tell you when to be out. So take a deep breath,you do have leverage here. If you made payment arrangements to the landlord,next time get a payment plan together for the back rent and have him sighn it. but then stick to the arrangement. If you go to a church,they may help also. I know someone that did that. Check with the housing authority in your area.

You really don't have much of a choice. You need to get a payday loan to make the rent. That is about all you can do. Wish I could be of more help, but it is one of the few reasons the courts will decided in favor of the landlord. Rent has to be paid.

Do you have any proof that he said it was OK and that he was going to work with you? Did you ask him why he changed his mind?
If you have a witness or proof of the conversation, it will stand up in court.
At least it always does on Judge Judy.

Get a loan, not a lawyer. You promised to pay, not to make your landlord pay for you to live!

You have to be 60 days behind before he can begin legal proceedings. He's just being a jerk. Ignore it and continue to stick to your word.
