Is it illegal to gag and tie someone up, against their will, while they sleep? (I will allow that this is a temporary solution, but still...i am curious, is it illegal?)

It's not legal and you'd be charged with several crimes. If you could prove an implied consent it's possible you'd escape prosecution. It would be difficult if he was sleeping. However you could get him to write out all his BDSM fantasies and hope that's one of them. You can then offer the defense of kinky sex act with consent. Last time I checked the buzz kill defense was still being heard by the supreme court and the precedent is still untested.

Hmmm...I'm thinking only if they press charges. But, just to make sure make them promise not to visit the police before you let them loose. Cause, ya know, when someone is tied up...they are always truthful and will never hold a grudge or anything.

yes it is illegal and unethical to gag and tie up some one both physically as we as emotionally
