1st degree is planned and premeditated. Thought out, on purpose. Very Very Bad!
2nd degree is spontaneous, could be in fit of anger or questionable self defense. Very Bad, but not as bad as 1st.
3rd degree would be through negligence or carelessness. Bad, but not as bad as the others.

Degrees of murders are outlined briefly as this:

1st Degree: Felony murder which is the most serious because it shows an intent or (deliberateness) to cause harm to another. It also has to show premeditation in order for it to classify as a 1st Degree. Often intent is implied if a weapon or torture was used. Depending on the evidence, implications can be seen as heinous, but accidents are not precluded from this category.

2nd Degree: Also a felony & premeditation by nature, but does not involve special circumstances. Also depends on the evidence presented in court.

3rd Degree: Can either be classified as a felony or misdemeanor, depending on the evidence. Defined as all other murders, including manslaughter with no premeditation, negligent killing, infanticide.

I guess that would depend on how the person killed the other. Was extreme force used? Weapons involved?? Premeditated??

Murder is murder in my book, 1st degree should be as bad as 3rd degree.
