Yes he will. If you are the one who will be the guardian and get custody of the boy, you will get the check. Be sure to keep all the receipts that you use the money for because you will get audited. That means the Social Security Office will ask that you submit a form of how you are using the money and will ask for receipts. Keep a box, folder, etc, with each month on the tab and put the receipts in there. If the SSA sees that you are not using the money for him, they can prosecute you and send you to jail/prison. Yes, i would think so..
My dad died a month before I was born..My mom got a check for me until I was adopted by my grandma, then grandma got it..
At 16, due to grandmas health I was emancipated as an adult and I received the social security check until I graduated high school at the age of 18...
So, yes..you will get a check for the care of your son, kind of like "child support".....

Your husband sounds like a big loser to leave you for that reason and yes your son should and you may receive some kind of extra help til you find a job.

Ok, enough editorializing... yes, your son will still receive social securty since the father (your husband, right?) will still have to provide for him.

your husband doesn't have to live with yall for your son to continue recieving payments (depending on where you live, all laws are different) but as long as the child is biologically his or has been adopted by him there shouldn't be a problem
