Its only discrimination if you are otherwise qualified for the job. It is not discrimination to refuse to hire an older person who is physically incapable of doing the work. An older worker may be perfectly capable of business managment and completely inappropriate for dropping crab pots in the Bering Sea. Um I find it to be a little bit of DISCRIMINATION going on. You need to check the laws in the state you live in. I live in Nevada and the employees here can fire you for no reason and it's legal. I would do some research. Then if you find it to be unfair then I would take some legal action.

Yes, age discrimination. A friend won a lawsuit over her company earlier this year because of that! She was laughing all the way to the bank because she was a year away from retirement and now she was paid for many, many, many years!!! Guess they should have kept their mouths SHUT!

no but it is againest the law...you cannot not hire someone based upon their age, race, religion, etc....Should someone (manager, director of human resources etc) tell a prospective employee that that they cant hire them based upon age they could wind up facing a big lawsuit....
