I am purchasing a modular home. My mother in law has purchased the property. She's nutzo. I want a notorized document to protect me and my family. What should my concerns be?

She said she would'nt evict us for any 'looney' reason, but I want to make sure she doesn't have an 'episode' and decide to put us out.

Also, what about when I build a garage, the deed is in her name? How should I contruct a document that clearly says that we can build whatever whenever?
What happens when we decide to move? How do we sell, the house, and the property?

I have a million concerns, what should I be sure to put in writing?

I'm a little unclear...the way I understand it, she owns the land, and you are going to build a modular home on it, right? This sounds like a problem waiting to happen.

She can say that she won't screw you over, but the fact is, that she could... she can legally make you move the modular home at her whim as it stands right now, unless there is some wierd variant in your state that I am unaware of. This would be no different than living in a mobile home park; they can evict you and make you move for any breach of contract....and you don't even have a contract at all! You need to get a formal agreement drawn up by someone who knows housing law in your state.

My advice? First, invest a few bucks and consult an attorney; they won't charge much for just a consultation, and can give you the proper advice as to how you can protect yourself.

As far as the garage, unlike the modular home, it is a permanent structure, and would be hers, since she owns the land.

My other advice...unless you really want to live under her thumb really badly, I'd find another lot somewhere else. If she is as you claim, it will be a nightmare, even if she doesn't evict you. Save yourself a lot of hassle and look at an alternative site, or at the least, try to buy the land from her somehow.

You need a lawyer in your state who is familiar with these issues.

Your mother in law would be crazy to sign anything like complete freedom for you to build whatever you want on the property.

You need an easement or long term lease to build the house, and you should have some way to buy the property from her, at least the right of first refusal.

As for moving, if it is a mobile home, you can take it with you. If it is a modular home built on site and not movable, it is not your mother in law who is "nutzo."

Put everything in writing even though it is family you still need to cover all of you bases, because you can't mess with the well being of your immediate family. Besides family is family but money is money and money can make people do things totally out of character ( and if she's looney to boot get it in writing). Good luck

Well.... she OWNS the property. SHE can do whatever they want..... unless you can have her decleard insane.

If you have a formal lease, you have certain rights. Did you have a formal agreement drawn up and executed?

You cannot sell the property without her signature or have a power of attorney.

There has to be more to this story. Why is it in her name? It should be in yours if you are paying for it, and it will be yours.

Never build on someone else's property. Buy the land from her.
