Can a man be awarded overnight visitation for his 3 year old if he has not tried to see her in over a year and a half nor sent any money to help with her? And he live with his girlfriend in her 1 bedroom apartment that is in her parent's name. I am just asking because I am the mother of this precious 3 year old girl and am aslo happily married now, and need to know if he can legally get upfront overnight visitation even though it has been a long time and she does not know him. And he doesn't have his own place but lives with his young girlfriend in her 1 bedroom apt. that her parents signed for her to get. Please help?

Most states allow the judge to do what is in the "best interests" of the child, thus giving the judge a wide range of discretion.

Generally, a non-custodial biological parent of a child has a right to some form of visitation unless such parent's parental rights have been terminated by the court. This is true in many states even though child support has not been paid.

You should probably talk to a lawyer to see what options you may have before the court.

What will probably happen first is he will have supervised visitation during the day for a few hours. I suggest you contact an attorney about custody and visitation rights and explore if it is in the child's best interest to begin a relationship with her father. Document everything you do and any conversations with him in a journal. If he is allowed visitation, I would urge you to advocate to supervised visits for 3 hours a week and see if he actually follows through with this or is he just trying to impress his girlfriend that he is a caring father.

If he hasn't paid his child support, he's going to have a very hard time convincing a judge that grant him visitation.
