I was demoted back in April of 06 I went to the OAG office to do a modification b/c my ex wife wouldnt sign off on it. She lives off that money (like getting her nails done, paying $500 purses, and going to fancy dinners) I know she doesnt use the money on my little girl...she calls me crying that she cant afford new panties for my daughter...and sends her to my house with shoes with holes!!!! It is not mid July and still hasnt been lowered, I am paying 820.00 a month for my one little girl...I havent even been able to see her in the past 3 months b.c I dont have the money to drive 200 miles to pick her up and bring her to my house and drive her back, the courts finally set a date for then end of sept. After it is all said and done with my ex is going to have gotten an extra 4000 in child support than i should be paying with my new income. Is there any way to get that credited to me? I just want it to be lowered asap so I can see my daugher and make sure she had the things she needs

i think that when you go to court in sept it will be modified back to the date of the demotion. you have to this the legal way and i know it sucks. its bad when responsible dads like you are treated this way. ill be praying for you and your daughter.

Women dont spend all the child support on the children. Unfortunately today custody has become a cash award for the one that gets the child. And that is 99% women. Sorry but until a judge signs an order changing support amount, by law it isnt considered over payment. She gets to keep it. You should have gotten a lawyer right away. Lawyers can expedite the courts date of hearing. You might have spent money on a lawyer but it would have been over with by now.

Wow.... you're gettin' it up the a$$!! Go to court and make her show receipts for EVERYTHING she is buying for your daughter to show how the money is spent. I don't think that you'll get any credit for that $$$ though. You can make sure that all that money is going to your daughter by making that receipt request though..... and she will have to provide proof of how ALL the money you give is spent.....

Contact the AG's office. Texas is wonderful about changing child support if the evidence is there.

Why , did your kid quit needing stuff? Come on dude, look after your kid, you helped bring her into the world, at least make sure she's okay while she's here. Bad enough she doesn't have full time family.
