It's perfectly legal, but once you're in International waters, you're legally "free game". Declaring yourself a "pirate" would allow anyone to literally, board your vessel, claim it as prize, and turn you over to the Coast Guard for prosecution.
This is law, but it is largely unknown and unenforced. Still.....................!!!!

Of course it is legal--that is, if you are an American. Other nations may have different freedoms (and ours is being threatened hourly by our current lame-duck president, curse him).
But no one is going to see it at a distance.
I suggest a pirates flag at the top of your mast. About six-feet long? Makes for a topic of conversation back at the harbor or club. And if you and hubby can mount a small napoleon on your foredeck, the impact would even be greater (cooler).

Yes it's legal. I saw a boat flying the Jolly Roger at Keuka Lake in New York, there were police boats patroling the water by the way, and the police on the police on their boats just sat back, relaxed, and tipped back on their precious Mountain Dew whenever they saw the boat. So yeah it's fine. Arrgh! Just watch out for Captain Jack! Tell him I said hi!

At one time, it was considered illegal to fly the skull and crosbones flag from the mast of any vessel. I don't know if that still applies, or whether it would apply to painting the mast of your boat. I would suggest checking with the maritime authorities about this.

I think its a cool idea. I couldn't see why it would be illegal. But then again there is a law saying you cant buy beer on Sundays before 12 so I guess they don't need a reason to make a law!
