The prostitute should be punished for being a prostitute: a known source of danger to the public, in part, because she spreads disease infections. The john should be punished for having sex with a prostitute because this is how disease infections spread.
But those are separate issues. Anybody who knowingly passes on an infectious disease should be punished for assault, and if the prostitute's victim dies, then she should be executed.

Uh.. NO. They're a prostitute. A guy knows what he's getting into the minute he gets one. It's not like the guy gets a prostitute and expects her to be absolutely free of any diseases or things that could be passed on to him.
Also, unprotected sex? There's only a few options a female has for unprotected sex. The GUY is the one that needs to wrap it up. If he doesn't, he deserves what he gets.

If they knowingly had the HIV virus and had unprotected sex and lied, then they should face criminal charges, however, sex is an act between two people(in some cases more) and it is a mutual responsibility and a "john" should have the decency to use protection for his safety and those around him that he may engage in sex with later, ie: his wife, girlfriend, boyfriend or other prostitutes. So both are responsible.

I'm sorry, but are you thinking at all when you ask such a question. No one ever told the customer he had to go to a prostitute in the first place. The rule of "Caveat Emptor",
"Let the Buyer Beware" be understood here. If he wants protection, it's in his power anyway, not hers.

You also have to assume that AIDS is a death sentence, which, many people with AIDS will tell you, is not, anymore.
It would be very difficult, if not impossible to prove the first case.
