Our roommate has shown that she can not clean after herself or her dog. When she first moved in she did not sign the lease because she "didn't like the landlord". ALSO after my fiance and I have confronted her about her lack of cleaning and her disgusting habits she has gotten very defensive. The other night after I wrote her a note that I picked up one of her bloody tampons off of the floor after her dog had chewed up she stormed into our room yelled and me, called me a F&%$@ing B*@#$, and threw the note in my face. So now I feel threatened. I have told my landlord she needs to get out... As she has not signed the lease is she LEGAL to live there? What sort of retaliation can I put forth on this matter?

You were right to tell the landlord. If the other roomate(s) also feel threatened by her behavior, you can also file a complaint with the local police.

It is really up to the landlord to have her evicted. In the US, this is usually done with a police officer delivering the notice to the applicable person.

Collectively and politely, ask her to leave within a couple of days or the following weekend. If she refuses, go through the landlord and let the police handle it.

In the meantime, try to stay out of her way as much as possible and keep your bedroom doors locked at night. Don't throw her belongings out the door or place them on the sidewalk as this may cause the problem to escalate into a violent encounter.

Hi Jen. I am very experienced in such matters having lived away from home since I was 8 years old.
When you take up a flat on lease, and if it is shared by a group of people and not a family per se every member of the group is bound to sign the agreement (lease) without which the person is deemed as guest only. If you and your fiance had taken her as the room mate to share the house, and she had not signed the lease papers along with you then she is at the most just a 'guest' which denotes that she can be asked to leave if she has extended her stay in premises and is causing a nuisnace to the tenants and the landlord.

The next time you get somebody else to share the flat, make sure she signs the lease papers whether the she likes the landlord or not. And be a bit wiser to choose somebody who is independent. That way you would not have to baby sit them or clean their muck. I really appreciate you for having the courage to pick her tampon. I doff my hat! Take care.

yes. If the tenant didn't sign the lease, she can be evicted. Also, if the lease specifies that she must maintain the property and not allowed to keep animals on the property, she can be evicted (even if she signed the lease)...

It'll take 2 notices.. then an officer.. in which the tenant will be forced to move out.

But it's all under the landlord's hands.. you can make a complaint. The landlord will have all the right to check the property, only because you signed the lease and she did not.

You can tell her to leave anytime and she can volunteer to leave anytime. Without a lease, she's responsible for paying a pro-rata amount of the previously agreed upon rent up to the day she leaves.
If she has paid you rent for the current month, then you either have to let her stay until the end of the month, or you have to refund the money for the days she's not there, or she can take you to court.
Make absolutely sure that you have receipts for all cash payments made and received !!

a 30 day notice is all that is required legally no matter what.. you simply write it up and hand it to her... make sure it is notorized (and make yourself a copy)(can do that for maybe $5 or $10 dollars sometimes at a bank.... ask around town for a "notary republic"... then its official.....30 days is plenty of time for her to leave or even change her ways if youd still be willing to let her stay... but you dont have to... with that letter she can be evicted, even by the cops if u call them and show them the letter. also take it down to the court house to be sure.

She's not legal to live there. You can kick her out at any time. If she gets nasty the cops can evict her. If you want just pack her stuff, and leave it at the door. Of course if she has paid rent for this month then she can legally take you to court to get that money back.

Take her stuff and place it on the sidewalk. If she is not on the lease, she does not have a legal right to reside on the premises.

If she calls the cops, let her. They will side with you. Then you can advise the cops that she is currently trespassing.

(Just how far are you willing to go on this one?)

unfortunally its harder to evict with no lease. you will have to go through the process. unless you can convince her that you dont have to, and tell her to leave. But since you feel threatened, you can file a ppo (personal protection order) and im pretty sure, with no lease, she would then have to leave.

I think you can just call the police and have her removed... if her name is not on the lease I don't think there is anything she can do about it... she sounds like a possible psycho!

with no contract or signature you should kick her az out an laugh the whole time then she'll respect you an your things before she even try to approach you again
