its just light being relected by the sun, its called earthshine, and is caused by the shallow angle of the sun, bouncing light off teh earth and partially illuminating the moon.
well, its either that or someone forgot to turn the light off.

The Moon orbits the Earth once a month while the Earth orbits the Sun once a year. This makes the Sun appear to move once around the Earth in a year during which the Moon really moves around the Earth twelve times. So the Moon is not always on the other side of the Earth from the Sun, it catches up with and passes the Sun in the sky 12 times a year. Just look at it every day (or every clear day) for a month and you will see. The Moon moves far enough in one day to easily notice. A crescent Moon will be quite near the Sun and a full Moon will be opposite the Sun, rising when the Sun sets and setting when the Sun rises.

The moon completes its orbit around the earth every 27 days. The earth completes 1 revolution approximately every 24 hours. The time at which you see the moon in the sky depends on where on the earth's rotation your part of the world "passes" by the moon's position. If that time happens to be daytime, and the conditions are right, then the moon will be visible during the day.

Why should it be on the other side of the world? The position of the moon has nothing to do with the position of the sun so half the time they are on the same side of the earth.
The moon is associated with night because that is when it is more obvious because it is not being dazzled out by the sun and it will be fuller at night.
Dodgy ascii art alert!
S=Sun
E=Earth
M=Moon
Full moon: S ------- E - M
New moon: S -------- M - E
Half moon:
.................M
S ------------ E

As the earth orbits (Goes around) the sun, so does the moon move around the earth. The moontakes 28 days in its orbit around the earth. The earth takes 365 days (1 year) to orbit the sun.

Check ou the site below. It's really as simple as this ... The moon revolves around the earth, therefore it will be visible during the day at certain points in its cycle.
